As the average age of our population increases, more people are confronted with
incapacity and disability issues than ever before. Statistics show that one spouse
from every married couple will spend some time in a nursing home or similar institution.
Who will pay these rising costs? Texas is currently near the bottom in cost per month for nursing home care. The average cost of a nursing home in Texas is almost $4,000 per month. But the same services in some states is $10,000 to $12,000 or more per month. The costs will continue to climb.
Medicaid is a federal program, but it is controlled by
state regulations.
Texas law makes qualifying for nursing home care through Medicaid more difficult than most
other states. Failure to plan an inheritance can also disqualify an individual who is
already receiving benefits. Estate and disability planning for the elderly is one of the
fastest growing areas of law. Contrary to popular belief, it is not necessary to “give away” or “spend down” all of a Medicaid Applicant’s assets in order to qualify. A consultation with one of our Certified Elder Law Attorneys will be a revelation as to how assets can be set aside to assist the Medicaid recipient to attain a higher quality of life while still qualifying for benefits.
